Grubbs v. Kanneganti, 07-40963
In a False Claims Act (FCA) action against a hospital and its doctors for Medicare/Medicaid fraud, the dismissal of the complaint is affirmed in part, where Plaintiff failed to allege that Defendant-Hospital acted with fraudulent intent, but reversed in part, where an FCA action does not require pleading reliance and damages.
