The Hampton Co. Nat'l Sec. Sur. LLC v. Tunica County Mississippi, 07-60859
In a suit alleging due-process, equal-protection, and First Amendment violations by a county and its sheriff for the removal of plaintiffs from a roster of approved bail bond agents, summary judgment for defendants is affirmed in part and reversed in part where: 1) defendant-sheriff was entitled to qualified immunity on the ground that he had not violated any clearly established constitutional rights of plaintiffs; 2) remand was necessary for a determination of whether defendant-county had violated any constitutional rights; and 3) plaintiffs presented evidence sufficient to raise triable factual issues on their equal-protection and First Amendment claims.
