Perez-Pimentel v. Mukasey, 07-60039

Petition for review of an order denying waiver of inadmissibility and an application for adjustment status is denied where: 1) 8 C.F.R. section 212.7(d) was a permissible construction of 8 U.S.C. 1182(h) and not ultra vires; and 2) section 212.7(d) is not impermissibly retroactive because it does not completely foreclose relief.
