Mem. Hermann Healthcare Sys. Inc. v. Eurocopter Deutschland, GMBH, 07-40994

In an action alleging, inter alia, that defendant assumed and breached a duty to warn its customers of a potential helicopter door defect, dismissal of plaintiffs' post-sale negligence claim is affirmed over a claim that the district court erred when it refused to carve out an exception for post-sale negligence claims to Texas's economic loss rule.
