Audler v. CBC Innovis Inc., 07-30229

In a class action brought against various defendants based on their allegedly erroneous determinations that property owned by plaintiff and the other class members was located outside of a Special Flood Hazard Area, plaintiff's appeal from a dismissal of the claims is dismissed in part and otherwise affirmed where: 1) plaintiff lacked standing to bring claims against any defendant other than one company which provides flood zone determinations to lenders; 2) under Louisiana law, the remaining defendant did not owe plaintiff a duty for purposes of negligence, negligent misrepresentation, and failure to warn claims; and 3) there was no reversible error as to dismissal of claims for detrimental reliance and breach of warranty.
