United States Fifth Circuit

US v. Cisneros-Gutierrez, 06-11156

In the hearsay context, plea hearings fall within the ambit of Federal Rule of Evidence 801(d)(1)(A). A conviction for defendant's participation in a drug dealing conspiracy is affirmed primarily as the district court did not err by admitting as substantive evidence under Federal Rule of Evidence 801(d)(1)(A) a redacted version of a witness's factual resume from his plea hearing that directly inculpated defendant.
