United States Fifth Circuit

Virgin Records Am. Inc. v. Thompson, 07-50067

In a copyright infringement action brought by Virgin Records and other recording companies against defendant alleging that he used a file-sharing program to illegally distribute digital audio files, denial of defendant's motion for attorney's fees under the Copyright Act after the case was dismissed is affirmed where there was no abuse of discretion in denying the fees considering, inter alia, that plaintiffs immediately moved to dismiss their suit after they identified the adult daughter that defendant eventually acknowledged might be responsible for the copyright infringement.
