Guidry v. Am. Pub. Life Ins. Co., 07-30085
In an action against an insurer involving a cash benefit policy that provides supplemental coverage to assist in offsetting costs arising out of the treatment of diagnosed cancer and other specified diseases, grant of defendant's motion for judgment on the pleadings is reversed where the policy term "actual charges" is ambiguous and could be interpreted to mean the "billed amount," as opposed to the amount that the insured ultimately owes.
