United States Fifth Circuit

United Disaster Response, LLC v. Omni Pinnacle, LLC, 07-30348

In a dispute involving a contract with a parish to perform post-hurricane repairs, an appeal from denial of defendant-parish's motion to dismiss is affirmed in part and dismissed in part where the lower court properly found that the parish is not an "arm of the state" and the court lacked jurisdiction to review a claim of error regarding a choice-of-forum clause.
