Burke v. Mukasey, 06-60710
An order affirming Jamaican citizen's removal from the country as an alien convicted of an aggravated felony is denied over a claim that the offense for which he was convicted, criminal possession of stolen property in the third degree in violation of N.Y. Penal Law section 165.50, does not qualify as a "theft offense" within the meaning of 8 U.S.C. section 1101(a)(43)(G).
