Equal Access for El Paso, Inc. v. Hawkins, 06-50599
In light of the Supreme Court's decision in Gonzaga Univ. v. Doe, 536 U.S. 273 (2002), the Medicaid Act's Equal Access provision, 42 U.S.C. section 1396a(a)(30)(A), does not confer individual private rights that are enforceable under 42 U.S.C. section 1983.
