Sung v. Keisler, 06-60539

Immigration and Naturalization Act section 204(j) involves an adjustment of status determination, and thus an IJ has jurisdiction to determine whether an approved visa qualifies for portability pursuant to section 204(j), including the jurisdiction to make the factual finding necessary to ascertain whether employment classifications are the same or similar as required by the statute.
