In an action arising from an investment amongst the parties in an indoor football team at defendant's civic center, summary judgment for defendant is reversed and remanded where: 1) dismissal of claims under the '33 and '34 Securities Acts was error because, contrary to the finding below, the information owner possessed at a particular time did not place him on inquiry notice as a matter of law; 2) claims under state law were similarly not barred by the statute of limitations; and 3) dismissal of another party's pendent claim was error.
