US v. Helm, 07-40091
A sentence imposed following defendant's conviction for being a convicted felon in possession of a firearm is affirmed over claims that: 1) the district court erred in sentencing him as an armed career criminal under the Armed Career Criminal Act (ACCA); 2) section 924(e) of the ACCA violates the due process clause; and 3) his sentence infringes on his Eighth Amendment rights.
