United States Fifth Circuit

Lincoln Gen. Ins. Co. v. Garcia, 05-20938

In a coverage dispute arising from an underlying negligence action involving a bus accident in Mexico, a judgment for the insurer in its declaratory judgment action is affirmed where: 1) there was no error in a holding that a federally prescribed form endorsement did not cover the bus accident in Mexico; and 2) there was no abuse of discretion in a denial of a motion for reconsideration which argued that the endorsement covered the insured's liability for negligent hiring, retention, and entrustment given that those acts occurred in the United States.
