In removal proceedings, a petition for rehearing en banc is denied as moot because the underlying decision is vacated and remanded to the BIA so that the government may follow through on its pledge to withdraw the charge of removability under section 1182(a)(2)(A)(i)(II) based on its concession that petitioner should not be removed on the basis of his vacated controlled substances conviction.
