In a suit under The Equal Opportunity Employment Act brought by a former nurse at a VA facility, summary judgment for the VA is reversed as: 1) a federal-sector employee suing under Title VII cannot seek a partial trial de novo from the final administrative disposition; but 2) plaintiff did not forfeit her rights under 42 U.S.C. section 2000e-16(c) under the circumstances present.
