United States Fifth Circuit

Smith v. Seacor Marine LLC, 06-30992

In an action seeking contractual indemnity for sums a third-party defendant may owe to plaintiff, who was injured in an oilfield accident which occurred off the coast of Louisiana, dismissal of defendant's complaint is affirmed where the contract under which the defendant sought indemnity is a non-maritime contract, thus the district court correctly held that the Louisiana Oilfield Indemnity Act precludes appellant's recovery.
