United States Fifth Circuit
Cole v. Gen. Motors Corp., 05-31070
In a suit over defective side-impact airbags, certification of a nationwide class is reversed and remanded with instructions to deny the certifications where plaintiffs did not sufficiently demonstrate the predominance requirement for class certification because they failed both to undertake the required "extensive analysis" of variations in state law concerning their claims and to consider how those variations impact predominance.
