Arismendez v. Nightingale Home Health Care, Inc., 06-40593

In a suit against an employer alleging gender discrimination in a decision to terminate plaintiff's employment, judgment as a matter of law for defendant is reversed where there was sufficient evidence to support the jury's verdict that defendant terminated plaintiff because of her pregnancy. The district court's remittance of the punitive damage award is affirmed where the court correctly applied the statutory cap on damages.
