United States Fifth Circuit

Alice L. v. Dusek, 07-50440

A motion stay all district court proceedings in the case at hand pending defendant's interlocutory appeal of the district court's denial of qualified immunity in a 42 U.S.C. section 1983 action is denied over a claim that plaintiff's appeal of the denial of qualified immunity was so broad as to divest the district court of jurisdiction to compel her compliance with discovery requests made in relation to Title IX claims against another party.
