Nat'l Labor Relations Bd. v. Allied Aviation Fueling of Dallas LP, 06-60737
An application for enforcement of an order issued against respondent-employer in response to its alleged violations of the National Labor Relations Act (NLRA) is granted over employer's claims that the NLRB: 1) failed to give sufficient weight to an allegation that an employee forged another employee's name on a grievance for his own benefit; 2) failed to give sufficient weight to the fact that the employee's behavior was not a common practice; 3) failed to give sufficient weight to the fact that the employee's discharge was consistent with company practice; and 4) applied the incorrect legal standard to its analysis of the burden of proof.
