United States Fifth Circuit

Am. River Transp. Co. v. US Maritime Servs., Inc., 05-30878

In limitation of liability proceedings arising from circumstances in which a longshoreman employed by petitioner died when he jumped from the barge on which he was employed into territorial waters in an attempt to save a co-worker who had fallen, dismissal of divorced parents' wrongful death action seeking damages for loss of society is affirmed as non-dependent parents may not recover for loss of society in maritime wrongful death actions.
