Walji v. Gonzales, 06-20937

When a U.S. Citizenship and Immigration Services (CIS) examination is premature because a mandatory security investigation is not complete, the 120-day time period of 8 U.S.C. section 1447(b) that allows for judicial adjudication of the matter, does not begin to run until CIS receives the FBI's "definitive response" described in 8 C.F.R. section 335.2(b).
