Romero-Rodriguez v. Gonzales, 05-60661

In the context of an alien's ineligibility to apply for a waiver of removal under INA section 212(c) if they have "served...a term of imprisonment of at least 5 years", the BIA may determine the length of an alien's term of imprisonment by using the date of the BIA's subsequent denial following the reopening of the case.
