Burrell v. Dr. Pepper/Seven Up Bottling Group, Inc., 06-10267

In a suit raising employment discrimination and retaliation claims against defendant-Dr. Pepper, summary judgment for the employer is affirmed in part as to the retaliation claim, but vacated in part where a jury could conclude on the record that Dr. Pepper's proffered reason for failing to promote plaintiff was false and that intentional discrimination was the real motive.
