US v. Rajwani, 05-10648

A conviction for aiding and abetting wire fraud resulting from a transfer scheme which caused elderly victims substantial financial losses is affirmed but the sentence, which was three times the mid-Guideline range, is vacated where the extent of the district court's upward departure on the sentence was excessive and rendered the sentence unreasonable. (Revised opinion)
