Brown v. Brown & Williamson Tobacco Corp., 06-30130, 06-30311
In a case arising from tobacco manufacturers' allegedly deceitful marketing of -Lights- cigarettes, partial denial of manufacturers' motion for summary judgment is reversed where the district court erred in finding that plaintiffs- claims, as presented at summary judgment, were not expressly pre-empted by the Federal Cigarette Labeling and Advertising Act.
