Positive Software Solutions v. New Century Mortgage Corp., 04-11432
In the context of the question of whether an arbitration award must be vacated for "evident partiality," 9 U.S.C. section 10(a)(2), due to an arbitrator's nondisclosure, the court finds that the Federal Arbitration Act (FAA) does not mandate the extreme remedy of vacatur for nondisclosure of a trivial past association. The remedy of vacatur is only warranted upon nondisclosure that involves a significant compromising relationship.
