Acara v. Banks, 06-30356

The Health Insurance Portability and Accountability Act (HIPAA) does not provide for a private cause of action. Dismissal of a suit brought against a doctor for disclosing plaintiff's medical information during a deposition without her consent is affirmed where there was no federal subject matter jurisdiction over the asserted claims, and there was no clear error in a determination that plaintiff remained a Louisiana resident and that there was no diversity.
