US v. Pineiro, 06-30242

In an appeal arising out of the post-Booker resentencing of defendant, defendant's sentence on drug-related charges is vacated pursuant to the government's claim of error where, by recalculating defendant's guideline range, the district court exceeded the circuit court's earlier mandate.
