Yoes v. Barnhart, 05-11287, 05-11288

A calculation of an award of attorneys' fees under the Equal Access to Justice Act (EAJA) is affirmed as the court declines to adopt the Eighth Circuit's rule requiring uniform cost-of-living adjustments throughout each district, and thus, the district court did not abuse its discretion when it considered and rejected plaintiff's request for a cost-of-living adjustment.
