United States Fifth Circuit
Hellenic Inv. Fund, Inc. v. Det Norske Veritas, 05-20862
In a maritime action involving the purchase of a ship by plaintiff, a ship-owning consortium, and the ship's condition and class status as determined by defendant-classification society, dismissal of the action is affirmed where, under the direct-benefit estoppel theory, plaintiff, a non-signatory, was bound to the forum-selection clause in a contract between defendant and the ship's seller.
