Malagon de Fuentes v. Gonzales, 04-60897
A petition for review of a removal order is denied where the BIA did not err in: 1) upholding an immigration judge's determination that petitioner was seeking admission to the U.S. as defined in a statute involving the admission of resident aliens convicted of certain offenses; and 2) concluding that petitioner was ineligible for a waiver of admissibility under 8 U.S.C. section 1182(h).
