Steering Comm. v. Exxon Mobil Corp., 05-30781

In a mass tort action, an order denying certification to members of a purported class alleging claims against defendant-oil company arising out of a fire in one of its facilities is affirmed where plaintiffs failed to demonstrate that their proposed class satisfied either the predominance or superiority requirements of Rule 23(b)(3).
