Louisiana Health Serv. & Indem. Co. v. Rapides Healthcare Sys., 04-31114

The Employee Retirement Income Security Act (ERISA) does not preempt section 40:2010 of the Louisiana Revised Statutes, which requires insurance companies to honor all assignments of benefit claims made by patients to hospitals, to the extent that it applies to fully insured ERISA plans.
