Texas Democratic Party v. Benkiser, 06-50812

Grant of an injunction to prevent the removal of Tom DeLay's name from a ballot for congressional election and to prevent the Republican Party of Texas (RPT) from replacing him with a new candidate is affirmed where: 1) the district court did not err when it held that the Texas ineligibility statute was unconstitutional as applied; and 2) alternatively, the declaration of DeLay's ineligibility violated the Texas Election Code.
