United States Fifth Circuit

A foreign sovereign's property must be in the U.S. when a district court determines whether an exception to the Foreign Sovereign Immunities Act (FSIA) immunity from execution applies. Further, prior to authorizing execution, a district court must find the facts necessary for the exception to apply.
