US v. Candia, 05-30213

Under Booker, the consecutive nature of a properly calculated guidelines sentence is reviewed for unreasonableness. Further, when a district court imposes a sentence according to the applicable advisory guidelines for imposition of a consecutive sentence, and also imposes that sentence within a properly calculated sentencing range, the sentence's consecutiveness enjoys a rebuttable presumption of reasonableness.
