United States Fifth Circuit
Garcia v. Quarterman, 05-50382
A Sandstrom-type error, relating to erroneous jury instruction, is subject to harmless error analysis. Grant of habeas relief for petitioner in an aggravated sexual assault, robbery, and kidnapping case is reversed where the Sandstrom error at issue, involving an accomplice-witness instruction was harmless, and a state habeas court properly rejected ineffective assistance claims.
