United States Fifth Circuit
United Fire & Cas. Co. v. Hixson Bros. Inc., 05-30696
In a declaratory action over an insurer's duty to defend its insured, partial summary judgment for defendant-insured is affirmed where allegations in an underlying case involving defendant's alleged failure to perform funeral services as required by certain burial insurance policies did not unambiguously exclude an insurer's coverage of defendant's liability.
