McGavock v. City of Water Valley, 05-60396
In a suit involving the application of a Fair Labor Standards Act (FLSA) overtime exemption for employees "engaged in fire protection activities," grant of partial summary judgment for plaintiffs, firefighters who spent some of their workweek engaged in dispatching duties, is reversed where a particular regulation no longer applied to plaintiffs, and thus it did not remove them from the overtime exemption.
