A conviction for conspiracy to distribute heroin is affirmed over claims of error regarding: 1) denial of a suppression motion; 2) a Brady violation; 3) Jencks Act violation; 4) admission of evidence; and 5) jury instruction. Defendant's sentence is vacated and remanded pursuant to a Booker claim.
