Moreno v. Dretke, 05-70017

Denial of habeas relief in a death penalty case is affirmed and a motion for a certificate of appealability is denied over claims of error regarding: 1) defendant's ineligibility for the death penalty by reason of mental retardation; 2) his ineligibility for the death penalty because he formed the mens rea to commit the murder in question before he was eighteen years of age; 3) denial of a suppression motion; and 4) ineffective assistance of counsel.
