Banda-Ortiz v. Gonzales, 04-61100

8 U.S.C. section 1129c(d) does not require that the Board of Immigration Appeals automatically toll an alien's voluntary departure period during the pendency of a motion to reopen. A petition for review of an order finding petitioner ineligible for cancellation of removal is denied where petitioner overstayed his voluntary departure date, and thus, was ineligible for cancellation of removal.
