Bennett-Nelson v. La. Bd. of Regents, 03-31198

In an equal access action by two hearing impaired students against their school under the Americans with Disabilities Act and the Rehabilitation Act, the dismissal of plaintiffs' claims is reversed since defendant, as a recipient of federal financial assistance, had waived its Eleventh Amendment immunity.
