MILOFSKY v. AM. AIRLINES, 03-11087
Dismissal of plaintiff's suit, alleging breach of fiduciary duty with regard to a transfer of their pension plans, is affirmed where plaintiffs lack standing since their suit alleges particularized harm to individual plan beneficiaries, and not the entire plan as required by ERISA.
