United States Fifth Circuit

IN RE TETRA APPLIED TECHS. L P, 03-30719

An exoneration stipulation is not required to protect a shipowner's rights under the Limitation Act. District court abused its discretion by requiring plaintiff, injured at the company's oil rig, to stipulate to exclusive federal jurisdiction over the company's claim of exoneration from liability before it would dissolve the stay of the state court proceedings.
