United States Fifth Circuit

SPECTOR v. NORWEGIAN CRUISE LINE LTD., 02-21154, 03-20056

Foreign-flagged cruise ships are not subject to Title III of the ADA unless and until Congress clearly expresses its intention to do so. Claims brought by disabled plaintiffs, seeking injunctive relief requiring defendant to remove certain barriers that obstructed their access to the ships' facilities, are accordingly dismissed.
