RICHARD v. HOECHST CELANESE CHEM. GROUP, INC., 02-41377

In a class action arising over injuries from faulty plumbing systems, dismissal for lack of subject matter jurisdiction with regard to plaintiff's 42 U.S.C. section 1983 due process claim, and dismissal for failure to state a claim upon which relief can be granted with regard to RICO claims, are both affirmed.
